3.1.3 Notice of Voluntary Resignation or Retirement

Faculty Members with Contracts 
Persons employed for the fiscal year or for the academic year of two semesters have an obligation to inform, as soon as practical, their immediate supervisor of their intention to resign on completion of an appointment period. Such persons shall give written notice of their intention to resign to the President no later than two (2) weeks after being notified of the terms of the Employment Contract for the next fiscal or academic year.

Faculty Members without Contracts 
Any member of the Faculty not included in the preceding paragraph who plans to leave the Institute shall give written notice at least thirty (30) days prior to the termination date.

Per BOR policy 8.3.4.1, if any faculty member employed under written contract for the fiscal or academic year is absent for ten (10) or more consecutive business days without written approval from the faculty member’s direct supervisor, it may be determined that said faculty member intends to abandon their position and voluntarily resign from the institution. This Determination will be made by the School Chair and the Dean of the College, or by Dean, Vice Provost, or equivalent unit leaders for units without School Chairs (the “Determining Party”).

The Determining Party must make and document reasonable efforts to contact the faculty member at least three (3) business days prior to issuing a Determination.

Once the Determining Party makes a Determination, 

  • the faculty member will be notified immediately in writing by the Determining Party. The effective resignation date shall be no less than ten (10) business days after notification is sent to the faculty member.

  • the Determining Party shall immediately seek the advice of the Faculty Advisory Committee or equivalent (“FAC”) in the faculty member’s unit. The FAC shall provide its advice before the effective resignation date. If the FAC does not concur with the Determination or a unit does not have a FAC, the Determining Party must obtain the Provost’s approval for the Determination.

The Determination may be revoked by the Determining Party or the Provost any time prior to the effective resignation date. At any time prior to the effective resignation date, the faculty member may request in writing that the Determining Party reconsider the Determination by providing explanation of the absence, requesting retroactive leave approval, requesting additional leave, and/or requesting discipline in lieu of the Determination. 

The faculty member may appeal the Determination in writing to the President within 20 business days following the effective resignation date. Upon receipt of such an appeal by the President, the Faculty Status and Grievance Committee (FSGC) will conduct an inquiry and provide a recommendation to the President. The FSGC inquiry and recommendation should be completed within ten (10) business days of the appeal being filed with the President. The advisory recommendation of the FSGC will not be binding on the President. If the President approves the appeal, the faculty member will be reinstated, effective the appeal approval date.
